TERMS AND CONDITIONS
  1. All bookings are taken on the understanding that the following conditions will apply in full in all circumstances.
  1. All horses and ponies must be transported with a valid equine passport. This is a legal requirement. An unregistered horse or pony can only be transported with prior agreement to enable time to arrange the required paperwork.
 
  1. All horses and equipment travel at the Customer’s risk, and all horses and ponies to be fully insured by the Customer. Michelle Miles and any of her agents or representatives (together, the “Carrier”) will take all reasonable precautions; however, in the event of an accident please note that the Customer is personally liable for their horse or pony in the event of injury or damage sustained to, or caused by, the horse or pony. Any damage to the vehicle must be paid for and the Customer will be liable to cover the cost of any such repairs.
 
  1. The Carrier reserves the right to refuse to transport any horse or pony that demonstrates dangerous behaviour or, unless the transport is to a vet, signs of illness. If a journey has to be cancelled for this reason the Customer will be entitled to a refund of the Balance of their payment, but shall not be entitled to any refund of the Deposit.
  1. The Carrier’s charges are payable by the Customer without any right of set off. The Customer shall pay a deposit of 50% of the transport fee (the “Deposit“) within 48 hours of booking, with the remaining balance of 50% (the “Balance“) payable 7 days prior to the date of transport.
  1. If the Customer cancels with 21 days’ notice or more, the Customer shall receive a full refund of the Deposit minus an admin fee of £20.
  2. If the Customer cancels with 7 days’ notice (but less than 21 days’ notice), the Customer shall receive a refund of 25% of the Deposit.
  3. If the Customer cancels with less than 7 days’ notice, the Customer shall not be entitled to any refund of the Deposit or the Balance.
  1. No responsibility will be taken for additional time taken or delays due to heavy traffic, poor weather conditions, breakdown of the vehicle or any other cause beyond the Carrier’s reasonable control.
 
  1. Risk and Insurance
 
  1. The Bloodstock shall be carried at the Customer’s risk in all respects and, without limitation, the Carrier shall not be liable for any of the following unless directly caused by the Carrier’s negligence:
  1. injury or sickness (including fatal injury or sickness) to the Bloodstock howsoever arising (including, without limitation, injury or sickness caused in whole or in part by a defect in, or accident involving, any vehicle in which the Bloodstock is carried or caused in the loading or unloading of the Bloodstock or in the handling or care, custody or control of the Bloodstock);
  2. delay or mistake in the carriage or delivery of the Bloodstock; or
  3. failure to follow any instruction or direction of the Customer.
  1. The Carrier shall not be liable to the Customer by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under this contract, for any consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of the Carrier or otherwise) which arise out of or in connection with the carriage of the Bloodstock.
  2. If the Customer or any of its employees, servants or agents, or any other person whether authorised by the Customer or not travels by transport arranged or provided by the Carrier under this contract (whether accompanying the Bloodstock or not) the Carrier shall be under no liability to such a person or his personal representatives for death or personal injury (except as required by law) or for any other loss or damage sustained by such persons.
  3. The Carrier is not obliged to agree to transport other property (i.e. tack or other riding equipment) with the Bloodstock, but in circumstances where the Carrier agrees to permit such property to travel with the Bloodstock, the Carrier shall not be liable for any damage to such property for any reason.
  4. For the avoidance of doubt, the Carrier shall have no obligation to insure or arrange for the insurance of the Bloodstock or of any person or other property traveling with the Bloodstock pursuant to this Contract.
  5. All veterinary costs or additional stabling must be covered by the Customer. Should, in the Carrier’s reasonable opinion, the Bloodstock require urgent veterinary attention at any time, and the Customer is not contactable, the Carrier reserves the right to contact a vet on behalf of the Customer, and the Customer will remain, under all circumstances, entirely responsible for all veterinary or emergency charges incurred.
  1. These terms and conditions are to govern any contract between the Carrier and the Customer and shall prevail over any terms put forward by the Customer unless the Carrier expressly agrees to them in writing. No conduct by the Carrier shall be deemed to constitute acceptance of any terms put forward by the Customer.
  1. The contract shall be governed by the laws of England and Wales.
